Conditions:
On 29 March 2017, the Commission subsequently granted an application by Robinvale Golf Club Inc to amend the conditions in the original decision. In particular, the Commission granted an extension to 1 July 2022 for a minimum of eighteen cabin rooms to be operational at the Robinvale Golf Club. The Commission further imposed additional conditions requiring Robinvale Golf Club Inc to make annual community contributions and to comply with the skills training partnership agreement with the Robinvale College.


A. Works:

(a) The venue operator must make fully operational a minimum of eighteen (18) cabin rooms, substantially similar to the cabins proposed by the Robinvale Golf Club (the Club) in its submission to the Commission dated 21 March 2017 (the Works), on land adjacent to the Club by 1 July 2022.

(b) If the Works referred to in condition A.(a) are not substantially completed by 1 July 2022, the approval to operate the additional 20 EGMs will lapse.


B. Community contributions:

(a) The Venue Operator will make cash contributions of at least $25,000 per annum from 1 July 2017 for as long as any of the additional 20 EGMs operate at the Premises (the Contribution):

a. The Contribution will be distributed for projects in the areas of health and education;

b. The Venue Operator must advertise annually in a local newspaper and online inviting submissions from organisations regarding the distribution of the Contribution to be made each year; and

c. Distribution of the Condition will be determined by the Community Fund Committee established by the Venue Operator, whose membership shall comprise one representative of the Venue Operator, one representative of the Swan Hill Rural City Council and one representative of the Community (selected by the Venue Operator). The Community Fund Committee must assess submissions from organisations in accordance with guidelines established by the Venue Operator.

(b) The Contribution referred to above must be in addition to the existing in-kind and cash donations made to community groups and sporting organisations valued at approximately $13,392.00 in the 2015/2016 financial year.

(c) If the Contribution is not made by the end of each financial year, or other clauses of condition B are not complied with, the operation of the additional 20 EGMs must cease immediately for as long as the Contribution (or outstanding part) remains outstanding and/or until relevant clauses are complied with.


C. Skills training partnerships:

(a) The Venue Operator will make facilities of the Club available to the Robinvale College to assist in the practical training of hospitality students of the College as detailed in the Heads of Agreement between the Club and Robinvale College dated 17 March 2017.

(b). The Venue Operator will make facilities of the Club available to the Robinvale College’s Clontarf Academy substantially in accordance with the Heads of Agreement between the Club and the Robinvale College’s Clontarf Academy dated 17 March 2017.

(c) The Venue Operator will provide $10,000 to the Robinvale College each year to be distributed as scholarships (the Scholarships) to be distributed in accordance with the Heads of Agreement between the Club and the Robinvale College dated 17 March 2017.

(d) The provision of the Scholarships and facilities referred to in Condition C (a-c) must be made annually and for as long as the additional 20 EGMs are in operation at the premises.

(e) If the amount referred to in Condition C (c) is not provided to the Robinvale College by the end of each financial year or the Venue Operator fails to make its facilities available (as outlined in the above clauses), the operation of the additional 20 EGMs must cease immediately for as long as the Scholarships (or outstanding part) remain outstanding or until the Venue Operator complies with the relevant clause.
