For any annual community contribution that is due and payable in 2020, the amount of the community contribution may be deferred until 1 July 2021.


Community contributions:

(a) The operator of the premises (the Venue Operator) must:
establish the Old Town 'N' Country Community Fund (the Fund); make the cash contribution referred to on Condition 1 (a)(iii) from the commencement of the operation of the six additional EGMs at the Hotel until 15 August 2022; the annual cash contribution will be the sum of $10,000 (indexed each year, commencing in 2015, by CPI all groups Melbourne) (the Contribution); and the Contribution will be allocated each year to not-for-profit community groups and sporting organisations providing services and facilities to residents in the Rural City of Wangaratta.

(b) The distribution of the Contribution in accordance with Condition 1 (a) above will be determined by a committee (the Committee) established by the Venue Operator comprising: two representatives of the Venue Operator; and one representative of Council, or if Council is unwilling to provide a representative, a community representative nominated by the Venue Operator.

(c) The Committee will advertise annually in a newspaper circulating in the Rural City of Wangaratta for submissions from not-for-profit community and sporting organisations, providing services and facilities to residents within the Rural City of Wangaratta, regarding the distribution of the Contribution to be made by the Venue Operator each year. The Committee will assess requests for cash contributions in accordance with guidelines to be established by the Committee.

(d) The Applicant currently makes cash contributions to sporting and community groups win the Rural City of Wangaratta in the sum of$5,350 per annum (Existing Contributions). In addition to the payment of the Contributions referred to in Condition 1 (a}, the Venue Operator must continue to pay each year the Existing Contributions until 15 August 2022.

(e) The Existing Contributions will be increased each year by reference to increases in the CPI all groups Melbourne for the preceding year.

(f) In the event that the Venue Operator sells or transfers the business at the Hotel to a third party (from the commencement of the operation of the 6 additional EGMs at the Hotel until 15 August 2022), the Venue Operator must, as part of the sale or transfer, require the purchaser or transferee to assume responsibility for the obligations in this Condition 1 (from the commencement of the operation of the 6 additional EGMs at the Hotel until 15 August 2022).
