Conditions:
For any annual community contribution that is due and payable in 2020, the amount of the community contribution may be deferred until 1 July 2021.


Community contributions/cash payments:

4. Subject to Conditions 5, 6 and 15, the venue operator must make cash payments totalling $75,000 (the Contribution) in each financial year (ending 30 June) commencing from the date any of the Additional EGMs commence operation (the Commencement Date) with the Contribution to be applied in accordance with Conditions 7 to 16.

5. The payment to be made for the first financial year following the Commencement Date must be a proportionate payment with the proportion being equal to:

(a) if the Commencement Date occurs between 1 July and 30 September inclusive, 100% of the Contribution; or

(b) if the Commencement Date occurs between 1 October and 31 December inclusive, 75% of the Contribution; or

(c) if the Commencement Date occurs between 1 January and 31 March inclusive, 50% of the Contribution; or

(d) if the Commencement Date occurs between 1 April and 30 June inclusive, 25% of the Contribution.

6. The Contribution must be increased each year by the increase in the Consumer Price Index All Groups Melbourne during the preceding year.

7. The venue operator must engage with the local FM radio station and create a community chest program (Community Chest Program) whereby $500 per week or alternatively $1,000 per fortnight (totalling $26,000 per annum) will be contributed to any not-for-profit organisation on the Mornington Peninsula. Any organisation seeking to access the Community Chest Program must be domiciled within the municipal boundaries of the Shire of Mornington Peninsula.

8. If all or any part of the funds as part of the Community Chest Program are not distributed in accordance with Condition 7, the venue operator must distribute those funds in accordance with Condition 9.

9. On a quarterly basis, the venue operator must distribute the balance of the Contribution (being 25% of the Contribution less any funds distributed through the Community Chest Program for that quarter) to any local not-for-profit community or sporting organisation, or gambling support service which provides services to the Shire of Mornington Peninsula, upon request for financial assistance.

10. The venue operator must publish in the local newspaper and advertise on the local FM radio station that a certain amount of funding (being 25% of the Contribution less any funds distributed through the Community Chest Program for that quarter) is available to local not-for-profit organisations from the venue operator subject to a bona fide written request setting out the reason/s why they need the assistance and the amount sought.

11. The venue operator must notify the Shire of Mornington Peninsula of any such quarterly publication, and consider any submissions made to it by the Shire in relation to how the funds for that quarter are to be distributed both via the Community Chest Program, and otherwise.

12. The publicising of the quarterly payment available from the Contribution referred to in Condition 10 must be triggered no earlier than 21 days before the end of the quarter and the venue operator must have distributed the quarterly payment within 7 days of the expiry of the relevant quarter.

13. The venue operator must distribute the Contribution subject to the following:

(a) If any sporting group seeks financial assistance from the Contribution, the assistance shall be by way of payment of invoices only. No cash must be provided to any sporting clubs or organisations which are seeking assistance from the Contribution.

(b) To the extent the cash contributions referred to above relate to items provided by the venue operator, the amount is to be calculated according to wholesale value, not retail value.

(c) If any amount of the Contribution is not distributed in accordance with Condition 9, the venue operator will contact Council to seek recommendations of which community or not-for-profit group(s) to direct funds to. The venue operator will distribute any remaining funds of the Contribution in accordance with Council’s recommendations, except if the recommendations are inconsistent with the objects or purposes of the venue operator.

14. The venue operator must provide a true and correct record of its Contributions to the Commission and to the Council annually by 31 July in each year, demonstrating that the Contribution has been made, in accordance with these conditions, in the previous financial year.

15. If any of the Additional EGMs permitted to operate at the Subject Premises do not commence to operate, or cease to operate as a result of any circumstance, including, but not limited to, the imposition of amendment of any regional cap or municipal limit, the venue operator may reduce the Contribution up to, but not exceeding, a prorata basis. Such a reduction is to be calculated by varying the $75,000 Contribution according to the proportion of the 50 EGMs which do not operate.

16. If the Contribution or any part of it is not made by the end of each financial year, the operation of the Additional EGMs must immediately cease for so long as the Contribution or the outstanding part remains outstanding.


Number of EGMs:

1. The maximum number of electronic gaming machines (EGMs) that may be operated at the Dromana Hotel, 151 Nepean Highway, Dromana (the Subject Premises) is 50.

2. The operation of any additional EGMs over and above 41 EGMs at the Subject Premises (the Additional EGMs) must not commence until buildings and works generally in accordance with the plans No. H9371 dated 16 October 2015 (the Plans) have been substantially completed to the satisfaction of the Victorian Commission for Gambling and Liquor Regulation (Commission).

3. If material changes are made to the Plans by the Council or by the Victorian Civil and Administrative Tribunal, the venue operator must seek consent from the Commission to have those plans as amended approved by the Commission as complying with Condition 2.


Gaming Room Hours:

The gaming room may only operate during the following times—

(a) On Anzac Day, between 12 noon and 1 am the following morning.

(b) On any other day of the year, between 8 am and 1 am the following morning.
